That is, rights depend on narratives to be articulated, understood, and made real. Because rights depend on narratives, it is important for scholars of both narrative and law to pay attention to the way the procedures in civil rights litigation enable and constrain narratives. On close reading, the narratives of civil rights cases demonstrate that the early stages of a case are essential to communicating and meaningfully protecting rights. For this reason, the right to develop one’s own narrative—to “tell one’s story”—should be recognized as a critical component of access to justice.
